ThermoLife International filed suit against competitor Gaspari Nutrition in Federal Court asserting claims for false advertising, unfair competition, and tortious inference with ThermoLife’s business. In the same law suit, ThermoLife has also sued Gaspari Nutrition’s President, Richard Gaspari, and formulators, Daniel Pierce and Bruce Kneller personally.

On May 26, 2011, ThermoLife International filed suit against competitor Gaspari Nutrition in Arizona Federal District, Case No. 2:11-cv-01056-DKD. ThermoLife asserts claims for false advertising, unfair competition, and tortious inference with ThermoLife’s business. In the same law suit, ThermoLife has also sued Gaspari Nutrition’s President, Richard Gaspari, and formulators, Daniel Pierce and Bruce Kneller personally.
ThermoLife has retained trail attorney Gregory B. Collins, from the law firm Kercsmar & Feltus, PLLC in Scottsdale Arizona. Addressing ThermoLife’s claims, Mr. Collins stated, “Because dietary supplements are not highly regulated like prescription drugs, there is a perception in the industry that anything goes. This is not the law. The law does not allow any company to benefit from deceptive advertising or selling drugs as dietary supplements.” ThermoLife requests that the Court disgorge any and all benefit that Gaspari has earned from its tortious conduct. ThermoLife estimates this amount may exceed $24,000,000.00.
